  • Criminal litigation refers to any trial that takes place in criminal court. Criminal litigation is different from civil litigation in that civil litigation involves a private lawsuit between two parties whereas criminal litigation is litigation involves a case by the state made against an individual.
  • In the state of Alabama, you can be charged with a DUI if you are caught behind the wheel with a blood alcohol concentration (BAC) of 0.08% or higher, even if your driving ability is not impaired. Alabama law states that if you are driving, you have given consent to submit to a chemical test for the purpose of determining the amount of alcohol in your blood.
  • Alabama law dictates that divorce courts will allow couples to file for divorce under either no fault or fault grounds. If it’s proven that the spouses cannot live together because of incompatibility of temperament or there’s been an irretrievable breakdown in the marriage, a no fault divorce can be granted according to Alabama divorce law. Fault divorce can be granted if the following conditions apply: adultery, imprisonment, crimes against nature, physically and incurably unable to enter into the marriage, habitual drug or alcohol use, violence, insanity, voluntary abandonment.

    Case Name Omitted (Civil Case - Negligence) Plaintiff, after purchasing a certain type of what he thought was diesel fuel, started having problems with his equipment, after it was discovered, by the investigative team of The Hazzard Law Firm, that the fuel was not in fact diesel, but regular gasoline. The Hazzard Law Firm, before suit was filed, was able to negotiate a settlement on behalf of the plaintiff for money that he lost from purchasing the defective gasoline and recovery for repairs to his equipment as a result of defendant’s negligence.

    State of Alabama v. Moore (Criminal Case - Drug Related) The Hazzard Law Firm successfully represented the defendant, Moore, in two drug cases. The defendant was riding with the co-defendant. The defendant did not have knowledge that there were drugs in the car. Under Alabama law, all occupants of a vehicle can be charged with constructive drug possession if no one confesses to ownership of the drugs. The car was stopped and the driver consented to the car being searched. After several court appearances and after it was proven that Moore did not have knowledge of the drugs, The Hazzard Law Firm was able to get both cases dismissed against the defendant.

    Jeter v. Newsome (Civil Case - Property Damage) The Hazzard Law Firm represented the defendant against a claim for property damage that the plaintiff alleged she negligently caused. This case was set for trial. The Hazzard Law Firm successfully litigated this case and the alleged charges were ultimately dismissed against the plaintiff.
